These Terms of Service (“Terms”) govern your access to and use of the Mangomobile application and related services (the “Service”), provided by Bloox LLC(“Bloox”, “we”, “us” or “our”), a limited liability company organized under the laws of the State of Delaware, United States. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can use Mango
You must be at least 13 years old and able to form a binding contract to use the Service. By using Mango, you represent that you meet these requirements and that the information you provide is accurate.
2. Your account
You sign in to Mango using Google or Apple. You are responsible for the activity that happens under your account and for keeping your sign-in method secure. You can delete your account at any time from within the app (Profile → Account → Delete account).
3. The Service
Mango helps you discover, save, and share places to eat and go out, build lists, and share recommendations with your circles. Place information — including names, addresses, hours, photos, prices, and other details — comes from third parties such as Google and from other users, and may be incomplete, inaccurate, or out of date. We do not verify this information and are not responsible or liable for errors in it. Always confirm details (such as hours, prices, or dietary options) directly with the venue before relying on them.
4. Your content and the rights you grant us
You keep ownership of the content you create on Mango — your lists, reviews, ratings, notes, and the photos and other images you upload (your “User Content”).
By submitting User Content, you grant Bloox a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully paid, transferable, and sublicensable license to host, store, use, copy, reproduce, modify, adapt, translate, create derivative works from, publish, publicly display and perform, and distribute your User Content for the purposes of:
- operating, providing, developing, and improving the Service;
- training, developing, and improving machine-learning and artificial-intelligence models and features; and
- indexing your content and making it discoverable within the Service and through third-party search engines.
Private lists. Content you keep in a list marked as private is excluded from public display, from indexing by search engines, and from use to train AI/ML models. We process private content only to provide the Service to you and the people you have shared that list with.
Ownership of derived materials. As between you and Bloox, Bloox owns all rights, title, and interest in the Service and in any models, aggregated or de-identified datasets, analytics, insights, and other materials we create using User Content. This license survives termination, although we will stop publicly displaying your User Content after you delete it or your account, subject to the retention described in our Privacy Policy and to copies already incorporated into trained models or aggregated or de-identified data.
Your responsibilities. You represent and warrant that you own or have all necessary rights to your User Content (including any images and any people shown in them) and that it does not infringe or violate the rights of any third party or any law. You also grant other users a non-exclusive license to access and use the User Content you choose to share with them or make public through the Service.
5. Feedback
If you send us ideas, suggestions, or feedback about the Service, you grant Bloox a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose, without any obligation or compensation to you.
6. Acceptable use
You agree not to:
- Post content that is unlawful, fraudulent, spam, harassing, hateful, or sexually explicit, or that infringes others’ rights.
- Harass, abuse, threaten, or impersonate other users.
- Submit fake, misleading, or junk reviews and lists.
- Interfere with, disrupt, scrape, or attempt to gain unauthorized access to the Service.
- Use the Service for any illegal purpose or in violation of these Terms.
We have zero tolerance for objectionable content and abusive behavior.
7. Reporting, moderation, and enforcement
Mango provides tools to report reviews and lists and to block other users. We review reports and may remove content, and suspend or terminate accounts that violate these Terms, in our reasonable discretion. We aim to act on reports of objectionable content promptly, typically within 24 hours, by removing the content and, where appropriate, removing the user who provided it.
8. Third-party services
The Service relies on third parties, including Google (authentication and place data), Apple (Sign in with Apple and push notifications), and the Expo push notification service. Your use of those features may be subject to the third party’s own terms and privacy policies.
9. Intellectual property
The Service, including its software, design, and the Mango name and logo, is owned by Bloox and protected by intellectual-property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights in the Service. These Terms do not grant you any right to use our trademarks without our prior written permission.
10. Copyright complaints
We respect intellectual-property rights. If you believe content on Mango infringes your copyright, send a notice to support@getmango.sh including: (a) identification of the copyrighted work; (b) the allegedly infringing content and where it appears in the Service; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; and (e) a statement, made under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act on their behalf. We may remove infringing content and terminate repeat infringers.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, and we make no warranty that place information, AI-generated suggestions, or recommendations are accurate, complete, or current. You rely on them at your own risk.
12. Limitation of liability
To the maximum extent permitted by law, Bloox will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US$100).
13. Indemnification
You agree to indemnify and hold harmless Bloox from any claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as the licenses you granted, ownership, disclaimers, and limitation of liability) will survive.
15. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute will be the state or federal courts located in Delaware, unless applicable law requires otherwise.
16. Apple App Store
If you download Mango from the Apple App Store, the following also applies:
- These Terms are between you and Bloox only, not with Apple, and Apple is not responsible for the Service or its content.
- Apple has no obligation to provide maintenance or support for the Service.
- Apple is not responsible for any product warranties, claims, or third-party intellectual-property claims relating to the Service; to the extent any warranty cannot be disclaimed, Apple may refund the purchase price (if any), and otherwise has no other warranty obligation.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-party list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
17. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Effective date” above and, where appropriate, notify you in the app. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
